投标人应具备的资格或业绩：(1)投标产品在中国关境外制造时，投标人的资格要求： ①制造商须在其所在地注册登记。 ②制造商可以独立参加投标；投标产品医疗器械注册证或医疗器械产品注册登记表中列明的代理人(下称“注册代理公司”)或投标产品的全国总代理也可参加投标，视同为制造商。 ③注册代理公司或投标产品的全国总代理须具有有效的医疗器械经营许可证。 (2)投标产品在中国关境内制造时，投标人的资格要求： ①具有有效的营业执照。 ②制造商可以独立参加投标；制造商（或制造商所在的集团公司）在中国关境内设立的具有独立法人资格的仅销售本制造商（或制造商所在的集团公司）产品的贸易公司也可参加投标，视同为制造商。 ③制造商须具有有效的医疗器械生产许可证，贸易公司须具有有效的医疗器械经营许可证。 (3)投标产品须具有有效的“中华人民共和国医疗器械注册证”。 ①若投标人所投产品为III类医疗器械，须具有有效的中华人民共和国医疗器械经营许可证；②若投标人所投产品为II类及以下医疗器械，须具有有效的中华人民共和国医疗器械经营备案证；
